If you’re not yet actively using your brand in U.S. commerce, you’ll need to file an intent-to-use (ITU) application as required by law. This application type includes an additional fee of $320 for one class, plus $200 for each additional class, to cover the eventual filing of a Statement of Use.

The Statement of Use is a formal declaration confirming that you’ve begun using the trademark in commerce after submitting the initial application. This step is essential to complete the registration process under an ITU filing.
