Can a trademark application be guaranteed?

No. No trademark application can be guaranteed to succeed. The outcome depends on how the IP office examiner assesses the mark's distinctiveness, whether any earlier marks pose a conflict, and whether third parties file oppositions during the publication period.

What can be done before filing is to assess the probability of success: a trademark search identifies potential conflicts, and a legal assessment of distinctiveness identifies whether the mark is likely to pass examination. These steps reduce the risk of refusal but cannot eliminate it entirely.
